Disposiciones generales

First Chapter.

General dispositions

SECCIÓN 1.

Objetivo y ámbito de aplicación

Regla 5.
Para los efectos de las presentes Reglas Administrativas, además de las definiciones contenidas en la Ley General de Equilibrio Ecológico y la Protección al Ambiente, en lo sucesivo se denominará:

1. Actividades Turísticas. Aquellas consistentes en la observación del paisaje, de la flora y la fauna silvestre en su hábitat natural y cualquier manifestación cultural, de forma organizada, sin alterar o dañar el entorno natural, incluyendo el turismo alternativo, mediante la realización de recorridos y visitas guiadas por guías y/o conductores autorizados en rutas dentro del Parque Nacional Arrecifes de Xcalak, con el fin de disfrutar y apreciar sus atractivos naturales, siendo las más comunes las siguientes: Buceo libre. Es la actividad en la que una persona combina la natación y la observación de la vida silvestre subacuática, auxiliada por uno o más de estos equipos: un tubo con boquilla para respiración o esnorquel, visor, aletas y chaleco salvavidas;
   Buceo autónomo, Es la actividad subacuática que se realiza con el auxilio de un equipo de respiración autónomo, tanque con aire comprimido o mezcla de gases, regulador de presión y chaleco de compensación, además del equipo de buceo libre; Recorridos ylo visítas. Son las actividades para disfrutar el paisaje o la observación por medio de senderos de la vida silvestre terrestre o acuática en embarcaciones motorizadas o no, las cuales pueden ser de cualquier tipo y dimensión, cuyo medio de propulsión sea con motores de combustión interna y/o eléctricos, con transmisión dentro, fuera, o dentro-fuera de borda.
2. Videograbación, fotografía y sonograbación terrestre o submarina. Son las actividades que se realizan con fines comerciales o culturales, haciendo aprovechamiento de los recursos paisajísticos o de las especies de flora y fauna, o bien, acompañando a los usuarios durante sus actividades para grabar su visita al Parque con cámaras submarinas o no, de vídeo o fotografía.
3. Capacitación. Curso de formación que se imparte con la finalidad de hacer aptos a los prestadores de servicios turísticos y/o sus empleados para garantizar el uso sustentable de los ecosistemas presentes en el Parque.
4. CONANP Comisión Nacional de Arcas Naturales Protegidas.
5. Conductor o guía. Miembro de la cooperativa turística y personal de los prestadores de servicios, que a través de la capacitación y acreditación por parte de SEMARNAT cuenta con conocimientos suficientes sobre ecología, medio ambiente, conservación, uso sustentable de los recursos naturales, así como de aspectos relevantes, culturales y arqueológicos del Parque Nacional Arrecifes de Xcalak, que desarrolla actividades y/o servicios de acompañamiento a los turistas y. visitantes para una mayor satisfacción, entendimiento y disfrute de los atractivos naturales e históricos del área protegida.
6. Consejo. El Consejo Asesor del Parque Nacional Arrecifes de Xcalak, constituido mediante Acta de fecha - ~- - r , como órgano de consulta y apoyo, integrado por representantes de los sectores público, social y privado, con injerencia en el área natural protegida.
7. Director. La persona designada por la Secretaría de Medio Ambiente y Recursos Naturales para llevar acabo las acciones de coordinación, ejecución y evaluación del Programa de Manejo del Parque Nacional Arrecifes de Xcalak y del Programa Operativo Anual.
8. Embarcaciones en tránsito. Son aquellas que navegan sin la finalidad de realizar actividades turísticas o de pesca comercial, dentro del Parque Nacional Arrecifes de Xcalak, para realizar traslado de personas o transporte de insumos, desechos, residuos o basura, no importando su punto de origen y destino, y estarán sujetas a lo dispuesto en las presentes Reglas Administrativas, particularmente en materia de rutas de navegación y a la zonificación del Parque.
9. Embarcaciones no motorizadas. Son aquellas de propulsión humana, de vela o de oleaje, dentro de las que se encuentran: kayacs, pedalonés, canoas, tablas de vela, veleros, tablas de oleaje en todos sus tipos y dimensiones, colchones de playa con o sin aditamentos transparentes para la observación de la vida marina.
10. Emergencia. Situación que surge de la combinación de factores diversos, creando sucesos o accidentes naturales o provocados por actividades humanas que no se esperaban y que ponen en riesgo o pueden dañar al individuo, la propiedad o al ambiente, por ejemplo huracanes, accidentes de buceo, derrames de hidro carburos, entre otros.
11. Investigación. Científica. Aquellas actividades que fundamentadas en el método
    científico, conlleven a la generación de información y conocimiento sobre el Parque
    Nacional Arrecifes de Xcalak, desarrolladas por una o varias instituciones de
    educación superior o centros de investigación, organizaciones no gubernamentales o personas físicas, calificadas como especialistas en la materia.
12. LAN. Ley de Aguas Nacionales y su reglamento.
13. LGEEPA. Ley General del Equilibrio Ecológico y la Protección al Ambiente y su reglamento.
14. LP Ley de Pesca y su reglamento.
15. Monitoreo. Actividad que,, mediante el registro continuo y sistemático de los parámetros cuantificables del ambiente o la sociedad y su evaluación, permite determinar como afecta la realización de actividades a los diferentes ecosistemas presentes en el Parque. Permiso, autorización y/o concesión. Al documento que expide la Secretaría de Medio Ambiente y Recursos Naturales a través de sus distintas unidades administrativas, por el que se autoriza la realización de actividades de exploración, explotación o aprovechamiento de los recursos naturales existentes dentro del polígono del Parque Nacional Arrecifes de Xcalak, en los términos de las distintas disposiciones legales y reglamentarias aplicables.
16. Personal. Todo aquel empleado de la Dirección del Parque Nacional Arrecifes de Xcalak.
17. Pescadores. Son las personas físicas o morales que realizan actividades de pesca dentro del Parque Nacional Arrecifes de Xcalak, debidamente autorizados por la SAGARPA.
18. Prestadores de Servicios Turísticos. A la persona física o moral que con fines de lucro, se dedica a la organización de grupos de visitantes que tienen por objeto ingresar al Parque Nacional Arrecifes de Xcalak con fines recreativos y/o culturales, y que requiere del permiso otorgado por la Secretaría de Medio Ambiente y Recursos Naturales, por conducto de la Comisión Nacional de Áreas Naturales Protegidas.
19. PROFEPA. A la Procuraduría Federal de Protección al Ambiente.
20. Programa de Manejo. Deberá sujetarse a las disposiciones contenidas en la dedaratona del área natural protegida de que se trate, y tendrá por objeto la administración de la misma.
21. Registro de Permisionarios. Control administrativo de carácter interno establecido por la Secretaría de Medio Ambiente y Recursos Naturales, a través del Director del Parque, para disponer de un padrón de embarcaciones, así como de prestadores de servicios, pescadores y usuarios que realizan sus actividades dentro del Parque Nacional Arrecifes de Xcalak, sin ningún costo para el permisionario.
22. Parque. El Parque Nacional Arrecifes de Xcalak, ubicado dentro del Municipio Othón P. Blanco, Estado de Quintana Roo, con una superficie total de 17,949 Ha, establecido mediante Decreto Presidencial publicado en el Diario Oficial de la Federación el 27 de noviembre de 2000.
23. - Reglas. Las presentes Reglas Administrativas.
24. SAGARPA. A la Secretaría de Agricultura, Ganadería, Desarrollo Rural, Pesca y Alimentación.
25. SCT. A la Secretaría de Comunicaciones y Transportes.
26. SECTUR. A la Secretaría de Turismo.
27. SDN. Secretaria de la Defensa Nacional.
28. SEA tARNAT. A la Secretaría de Medio Ambiente y Recursos Naturales.
29. SM-AM. A la Secretaría de Marina-Armada de México.
30. Turismo Alternativo.Viajes que tienen la finalidad de realizar actividades recreativas en contacto directo con la naturaleza y con las expresiones culturales que la envuelven, con una actitud de compromiso de conocer, respetar, disfrutar y participar en la conservación de los recursos naturales y culturales.
31. Usuarios. Aquellas personas que ingresan al Parque Nacional Arrecifes de Xcalak, con excepción de los pescadores, para realizar actividades turísticas, recreativas, culturales, de esparcimiento o de otro tipo sin fines de lucro, utilizando embarcaciones o cualquier otro equipo o medio de transporte.
32. Zonificación. Sistema mediante el cual se divide el Parque en zonas geográficas específicas, en atención a sus caractérísticas ecológicas, ambientales, de conservación y aprovechamiento, para las que se definen las actividades y usos permisibles, así como la intensidad y características de los mismos.

Rule 5.
For the effects of the present Administrative Rules, in addition to the definitions contained in the General Law of Ecological Balance and the Protection to the Atmosphere, in the succeding piece we will defining the following:

1. Tourist Activities. Those consisting of the observation of the landscape, the flora and the wild fauna in its natural habitat and any cultural manifestation, of organized form, without altering or damaging the natural surroundings, including the alternative tourism, by means of visits and tours guided by guides and/or conductors authorized in routes inside the National Park Reefs of Xcalak. These, with the purpose of enjoying and appreciating its attractive natural resources, being the most common activities:Free diving: It is the activity in which a person combines the swimming and the observation of the subaquatic wild life, helped by one or more of these equipment: a tube with mouthpiece for breathing or snorkel, mask, fins and life jacket;
   Independent diving: Is the subaquatic activity carried out with the aid of independent breathing equipment, tank with compressed air or gas mixture, pressure controller and a buoyancy control device, in addition to the free diving gear. Visits and/or tours: They are the activities by which one can enjoy the landscape or the observation by means of on land and aquatic paths, sailing in not/motorized boats. Boats which can be of any type and dimension, with means of propulsion such as electrical motors of internal combustion and/or, with transmission, outside, or up-and-down of hut.
2. Videorecording, photographing, terrestrial or submarine soundrecording. They are the activities carried out with commercial or cultural aims, taking advantage of the landscaping resources or the species of flora and fauna, or, accompanying to the users during its activities to record its visit to the Park with submarine cameras or not, of video or photographs.
3. Qualification. Training courses given with the purpose of educating the touristic service providers and/or employees in order to make them capable and guarantee the sustainable use of the present ecosystems in the Park.
4. CONANP: National Commission of Protected Natural Reserves.
5. Guides: Member of the tourist and personal cooperative of service providers, that through the qualification and accreditation on the part of SEMARNAT count on sufficient knowledge on ecology, environment, conservation, sustainable use of the natural resources, as well as of excellent cultural and archaeological aspects of the National Park Reefs of Xcalak, that develop to activities and/or services of accompanying and guiding the tourists and visitors with the purpose of a greater satisfaction, enjoyment and understanding of the beauty of the natural and the historical resources of the protected area.
6. Council. The Advisory Council of the National Reef Park of Xcalak, constituted by means of the Act of date - ~ - - as consultative agency and support, integrated by representatives of the public, social and private sectors with influence in the protected natural area.
7. Director. The person appointed by the Ministry of Environment and Natural Resources (Secretaria of Medio Ambiente y Recursos Naturales) to oversee the coordination, execution and evaluation of the National Reef Park of Xcalak's Management Program as well as the Annual Operative Program.
8. Boats in transit. They are those that sail, without the purpose of carrying out tourist activities or of commercial fishing, within the National Reef Park of Xcalak, to make transfer of people or transport of supplies, waste or garbage regardless their point of origin or destination. The latter will be subject to the present Administrative Rules, particularly in the matter of routes of navigation and to the zoning of the Park.
9. Non motorized boats. They are those of human propulsion, sail or motion of the waves. They are: kayacs, pedalonés, canoes, sailing boards, sailboats, surfing boards in all its types and dimensions, beach mattresses with or without transparent additions for the observation of the marine life.
10. Emergency. Situation that arises from the combination of diverse factors, creating events or accidents caused by unexpected human activities which put the individual at risk or might hurt him, his property or the environment. For example, hurricanes, diving accidents, spills of hidrocarbons among others.
11. Scientific research. Those activities based on the scientific method
    with the purpose of the generation of information and knowledge on the National Reef Park of Xcalak. These activities are developed by one or several institutions of
    higher education or nongovernmental research centers, or private individuals who are specialists in the matter.
12. LAN:National Water law and its regulation.
13. LGEEPA: General law of the Ecological Balance and the Protection to the Atmosphere and its regulation.
14. LP: Fishing law and its regulation
15. Monitoreo. Activity that, by means of the continuous and systematic registration of the quantitative parameters of the atmosphere or the society and its development, allows to determine the effects that the various activities have in the park's ecosystems. Permission, authorization and/or concession: the document issued by the Ministry of Environment and Natural Resources via its various administrative units by which by which it is authorized either to conduct exploration activities or usage of the resources within the polygon of the National Reef Park of Xcalak under the legal terms and applicable
16. Personnel: All the employees working in the Direction of the National Park Reefs of Xcalak.
17. Fishermen. They are the physical or moral people who make activities of fishing within the National Reefs Park of Xcalak, properly authorized by the SAGARPA.
18. Lenders of Tourist Services. To the physical or moral person who with profit aims, dedicates his/herself to the organization of groups of visitors who intend to enter the National Reef Park of Xcalak with recreational and/or cultural purpose and
    that requires of the authorized by the Secretariat of Medio.ambiente and Recursos Natural, by conduit of the National Commission of Protected Natural Areas.
19. PROFEPA: the Federal Office of the judge advocate general of Protection to the Atmosphere.
20. Program of Handling. It will have to subject to the dispositions contained in dedaratona of in question protected natural area, and will intend the administration of the same one.
21. Registry of Permisionarios: internal administrative control established by Secretaria de Medio ambiente y recursos naturales, through the Director of the Park, to have a register of boats, as well as of lenders of services, fishermen and users who make their activities within the National Reef Park of Xcalak, without no cost to the permisionario.
22. Park. The National Reef Park of Xcalak, located within the Municipality Othón P. Blanco, State of Quintana Roo, with a total surface of 17.949 Has, established by means of Presidential Decree published in the Official Newspaper of the Federation the 27 of November of 2000.
23. - Rules. The present Administrative Rules.
24. SAGARPA: To the Ministry of Agriculture, Cattle ranch, Rural Development, Fish and Feeding.
25. SCT. To the Ministry of Communications and Transports.
26. SECTUR. To the Ministry of Tourism.
27. SDN. Ministry of the National Defense.
28. SEMARNAT: To the Ministry of Environment and Natural Resources.
29. SM-AM. To the Ministry of Navy-Army of Mexico.
30. Alternate tourism: tourism which has the purpose of conducting recreational activities in direct bonding with the nature and the cultural expressions that surround it, with an attitude of commitment to know, respect, enjoy and to participate in the conservation of the natural and cultural resources.
31. Users. Those people who enter the National Reef Park of Xcalak, with exception of the fishermen, to make tourist, recreational, cultural or relaxation activities or any other type without profit aims, using boats or any other equipment or means of transport.
32. Zoning: System by means of which the Park is divided in specific geographic zones based on its ecological and environmental characteristics with the purpose , of conservation and advantage, for which the permissible activities and uses are defined, as well as the intensity and characteristics of such.
    

Regla 8.
Deberá, presentar un aviso acompañado con el proyecto correspondiente, al Director, quienes pretendan dearrollar las siguientes actividades:

1. Educación ambiental que no implique ninguna actividad extractiva;
2. Investigación sin colecta o manipulación de especímenes de especies no
   considreadas en riesgo;
3. Monitoreo sin colecta o manipulación de especímenes de especies no consideradas en riesgo;
4. Filmaciones, actividades de fotografía, la captura de imágenes o sonidos por cualquier medio, con fines científicos, culturales o educativos, que requieran de equipos compuestos por más de un técnico especializado como apoyo a la persona que opera el equipo principal.
5. El aprovechamiento de la vida silvestre, así como el manejo y control de
   ejemplares y poblaciones que se tomen perjudiciales.
6. EL aprovechamiento de recursos biológicos 'con fines de utilización en la
   biotecnología.
7. Aprovechamiento forestal.
8. Aprovechamiento de los recursos pesqueros.
9. Obras que, en materia de impacto ambiental, requieran de autorización en los términos del artículo 28 de la Ley.
10. Uso y aprovechamiento de aguas nacionaiés.
11. Uso y aprovechamiento de la zona federal marítimo terrestre
12. Prestación de servicios turísticos:
    a) visitas guiadas incluyendo el aprovechamiento no extractivo de vida silvestre.
    b) recreación en vehículos terrestres, acuáticos, subacuáticos y aéreos.
    c) pesca deportivo-recreativa.
    d) campamentos.
    e) servicios de pernocta en instalaciones federales y
    f) otras actividades turístico recreativas de campo que no requieran vehículos.
13. Filmación, actividades de fotografía, la captura de imágenes o sonidos por cualquier medio, con fines comerciales que requieran de equipos compuestos por más de un técnico especializado como apoyo a la persona que opera el equipo principal.
14. Actividades comerciales, excepto las que realicen dentro de la zona de asentamientos humanos, y
15. Obras y trabajos de exploración y explotación mineras.
16. Restauración y/o repoblación, en aquellas áreas terrestres o marinas que lo requieran.

Durante el desarrollo de las actividades a que se refieren las fracciones anteriores, los interesados deberán respetar lo siguiente:

1. Depositar la basura generada en tos lugares señalados para tal efecto;
2. Atender las observaciones y recomendaciones formuladas por el pérsonal del área
   natural protegida, relativas a asegurar la protección y conservación de los
   ecosistemas del área;
3. Respetar las rutas, senderos y señalización establecida;
4. No dejar materiales que impliquen riesgos de incendios en el área;
5. No alterar el orden y condiciones del sitio que visitan;
6. No alimentar, acosar o hacer ruidos intensos que alteren a la fauna silvestre;
7. No cortar o marcar árboles o plantas;
8. No apropiarse de fósiles u objetos arqueológicos;
9. No encender fogatas con vegetación nativa, y
10. No alterar los sitios de anidación refugio y reproducción de especies silvestres
    

Rule 8.
A warning accompaning the project proposal should be presented to the Director if the following activities wish to be performed:

1. environmental Education that does not imply any extractive activity;
2. Investigation without collection or manipulation of species not
   considered at risk;
3. Monitoring without collection or manipulation of species not
   considered at risk;
4. Shootings, activities of photography, the capture of images or sounds by any means, with scientific aims, cultural or educative, that require of equipment made up of more of a technician specialized like support the person who operates the main equipment.
5. The usage of the wild life, as well as the handling and control of
   unit and populations that take themselves detrimental.
6. The usage of biological resources with aims of use in the
   biotechnology.
7. forest usage.
8. The usage of the fishing resources.
9. Works that, in the matter of environmental impact, they require authorization in the terms of article 28 of the Law
10. Water use and national waters.
11. Use and advantage of the terrestrial marine federal zone
12. Benefit of tourist services:
    a) visits guided including the nonextractive advantage of wild life.
    b) recreation in terrestrial, aquatic, subaqueous and aerial vehicles. C) it fishes sport-recreational.
    d) campings.
    e) services of spends the night in federal facilities and
    f) other recreational tourist activities in the field that do not require vehicles.
13. Shooting, activities of photography, the capture of images or sounds by any means, with commercial aims that require of equipment made up of more of a technician specialized like support the person who operates the main equipment
14. Commercial activities, except which they make within the zone of slumses, and
15. Works and works of mining exploration and operation.
16. Restoration and/or repoblación, in those terrestrial or marine areas that require it.

During the development of the activities to that the previous fractions talk about, the interested ones will have to respect the following thing:

   ecosystems of the area;
3. To respect the routes, footpaths and established signaling;
4. not to leave materials that imply fire risks in the area;
5. Not to alter to the order and conditions of the site that visit;
6. not to feed, to harass or to make noises intense that alter to the wild fauna;
7. not to cut or to mark to trees or plants;
8. not to take control of fossils or archaeological objects;
9. not to ignite bonfires with native vegetation, and
10. not to alter to the anidación sites refuge and reproduction of wild species

Regla 10.
Para la obtención de las autorizaciones a que se refiere prestación de servicios turísticos en la Regla 6, el promovente deberá presentar una solicitud que cumpla con los siguientes requisitos:

1. Nombre o razón social del solicitante, nacionalidad (acta de nacimiento), domicilio para oír y recibir notificaciones, número de teléfono y fax, en su caso, copia de una identificación oficial o acta constitutiva de la sociedad y poder para actos administrativos;
2. Tipo y características del o los vehículos que se pretendan utilizar para la realización de la actividad, en el caso de embarcaciones se deberá anexar los certificados de registro y una fotografía de la misma; si son embarcaciones similares presentar una sola fotografía, indicando el número total;
3. Descripción de la actividad;
4. Duración de la actividad;
5. Programa de actividades a desarrollar, en el cual se incluyan períodos, horarios de salida y regreso, tiempo de estancia en el Parque y ubicación de la zona de manejo donde se pretendan llevar a cabo dichas actividades:
6. Número de visitantes, 8 personas ¡Ha/hora;
7. Las características del equipo que se utilizará;
8. Para personas físicasy/o morales, póliza de seguros de viajero y tripulante;
9. Especificación y manejo de los desechos orgánicos e inorgánicos generados durante los recorridos; y
10. Acreditar el pago de derechos correspondiente, bajo los términos establecidos en la Ley Federal de Derechos.

Todos los documentos deberán ser entregados por duplicado a la Dirección del Parque, dirigidos al Presidente de la Comisión Nacional de Areas Naturales Protegidas, con domicilio en Camino al Ajusco # 200, Ala Norte, 3er Piso, Jardines de la Montaña. CP. 14210 México, Distrito Federal.

Rule 10.
For the obtaining of the authorizations rgarding the tourist services mentioned in Rule 6 , the promotor will have to present/display a request that fulfills the following requirements:

1. Name or trade name of the applicant, nationality (birth certificate), address to hear and to receive notifications, telephone number and fax, in its case, copies of an official identification or incorporation papers of the society and power for administrative acts;
2. Type and characteristics of the vehicle or vehivles that are intended to be used forr the accomplishment of the activity. In the case of boats, a copy of the title deed and a photograpf of the boat/s in question will have to be annexed. If they are similar boats, a single photograph indicating thtotal number of them will have to be presented/displayed.
3. Description of the activity;
4. Duration of the activity;
5. Plan of the activities to be acomplished, in which periods, schedules of exit and return are included as wekk as time of stay in the Park and location of the zone in which the activities are intended to be carried out.
6. Number of visitors, 8 people per Ha/hr
7. The characteristics of the equipment that will be used;
8. For private people or companies, an insurance policy of traveller and crew member is requeired;
9. Specification of the handling of the generated organic and inorganic waste created during the routes; and
10. To credit the payment of the corresponding rights, under the terms established in the Federal Law of Rights.

All the documents will have to be given by duplicate to the Direction of the Park, directed to the President of the National Commission of Protected Natural Areas, with address in: Camino al nr. 200, Ala Norte, 3er. piso, Col. Jardines de la Montana, C.P.14210. Mexico, D.F.

Regla 15.
Para el otorgamiento de las autorizaciones a que se refiere a filmaciones, actividades de fotografía o captura de imágenes y sonidos a la que se refiere la Regla 6, el solicitante deberá presentar una solicitud que cumpla con los siguientes requisitos:

1. Nombre o razón social del solicitante, domicilió para oír y recibir notificaciones, número de teléfono y fax, en su caso, y copia de una identificación oficial o acta constitutiva de la sociedad o asociación;
2. Datos del responsable del desarrollo de las actividades;
3. Tipo y características del los vehículos que se pretendan utilizar para la realización de la actividad;
4. Programa de actividades a desarrollar, en el cual se incluya, fecha, horarios de ingreso y salida, tiempo de estancia en el área natural protegida y ubicación del área o nombre de las localidades donde se pretendan llevar a cabo dichas actividades;
5. Número de personas auxiliares;
6. Tipo de equipo a utilizar para ta actividad;
7. Carta de exposición del tipo de filmación, videograbación ylo tomas fotográficas indicando el fin de las mismas; y
8. Acreditar el pago de derechos correspondiente, en su caso, de acuerdo a lo establecido por la Ley Federal de Derechos vigente.

Todos los documentos deberán ser entregados por duplicado a la Dirección del Parque, dirigidos al Director de la CONANP, con domicilio en, Camino at Ajusco # 200, Ala Norte, 3er Piso, Jardines de la Montaña. GP. 14210 México, Distrito Federal.

Rule 15.
For the granting of the authorizations such as filming activities , photography or capture of images and sounds to which Rule 6 talks about, the applicant will have to present/display a request that fulfills the following requirements:

1. Name or trade name of the applicant, domiciled to hear and to receive notifications, telephone number and fax, in its case, and copies of an official identification or incorporation papers of the society or association;
2. Data of the person in charge of the development of the activities;
3. Type and characteristics of or the vehicles which are intended to be used for the accomplishment of the activity;
4. Program of activities to be developed, in which it is included, date, schedules of entrance and exit, time of stay in the natural area protected and location of the area or names of the localities where they activities are to be carried out;
5. Number of auxiliary people;
6. Type of equipment to use for the activity;
7. Letter of exhibition of the type of filming, videofilmingand/or photography takings indicating the aim of the same ones; and
8. To credit the payment of the corresponding rghts, in its case, according to the established by the effects of the Federal Law of Rights.

All the documents will have to be given by duplicate to the Direction of the Park, directed to the Director of the CONANP, with address in, Camino al Ajusco # 200, Ala Norte, 3er Piso, Jardines de la Montaña. CP. 14210 México, Distrito Federal.

Regla 19.
El refrendo de los permisos deberá solicitarse a mas. tardar el 30 de abril de cada año, durante la vigencia del permiso, ante la CONANP, y estará sujeto a:

1. La evaluación del comportamiento del permisionario con base en la tabla de sanciones durante la temporada anterior.
2. La presentación en tiempo y forma del informe final de actividades ante la CONANP, mismo que deberá entregarse a mas tardar el 30 de abril de cada año. La no presentación de dicho informe durante el periodo establecido podrá ser sancionada con la cancelación o el no refrendo del permiso.
3. Al cumplimiento por parte del permisionario de los lineamientos y condicionantes establecidos en el permiso correspondiente, y
4. A la evaluación técnica que realice la CONANP, mediante el análisis de su situación particular.

Durante el año administrativo los permisionarios que no efectúen el trámite de refrendo ante la CONANP en el plazo establecido, perderán el derecho de obtenerlo por ese solo
hecho.

Rule 19.
The countersignature of the permissions will have to be asked for at the latest on the 30th of April of every year and during the validity period of the permission. The request will have to be asked to the CONANP, and will be subject to the following:

1. The evaluation of the behavior of the permisionario, based on the table of sanctions, during the previous season.
2. The in time presentation of the the closing report of activities before the CONANP, same that will have to handed in by the latest on the the 30 of April of every year. The presentation of this report during the established period could not be sanctioned with the cancellation or the noncountersignature of the permission.
3. To the fulfillment on the part of the permisionario of the allingments and conditions established in the corresponding permission, and
4. To the technical evaluation that the CONANP makes, by means of the analysis of its particular situation.

During the administrative year the permisionarios that do not carry out the countersignature proceeding before the CONANP in the established term, will lose the right to obtain it by that single one
fact.

SECCIÓN 1.
Disposiciones Generales

SECTION 1.
General Dispositions

Regla 22.
En los casos de contingencia ambiental o de emergencia ecológica:

1. Se estará a lo dispuesto por los Capítulos II del Título Primero y Ill del Título Sexto de la Ley General del Equilibrio Ecológico y la Protección al Ambiente,
2. El Director del Parque se mantendrá en estrecha coordinación con la SCT a través de sus Capitanías de Puerto en Chetumal, Xcalak y Mahahual, la SMAM, la SON, la PROFEPA y las demás instancias involucradas, para garantizar la seguridad de los usuarios del Parque y tomar las decisiones que le correspondan en el marco de las disposiciones legales aplicables.
3. En los casos en que entre en acción el Sistema Estatal de Protección Civil, el
   Director del Parque se coordinará con la Dirección Municipal competente para dichos
   casos.

Rule 22.
In the cases of environmental contingency or ecological emergency:

1. one will be to disposition by the Chapters II of the Title the First and III of the Title Sixth of the General Law of the Ecological Balance and Protection to the Atmosphere,
2. The Director of the Park will stay in narrow coordination with the SCT through his Harbor authorities in Chetumal, Xcalak and Mahahual, the SMAM, IS it, the PROFEPA and the other involved instances, to guarantee the security of the users of the Park and to make the decisions that correspond to him within the framework of the applicable legal dispositions.
3. In the cases where the State System of Civil defense is put into action, the
   Director of the Park will work in coordination with the competent Municipal Authority in those specific cases.

1. Buceo libre.
2. Buceo autónomo diurno.
3. Buceo autónomo nocturno.
4. Recorridos y/o visitas en embarcaciones motorizadas.
5. Recorridos y/o visitas en embarcaciones no motorizadas.
6. Embarcaciones en tránsito
7. Videograbación, fotografía y sonograbación comerciales.
8. Investigación científica.
9. Educación ambiental.
10. Pesca cooperativada comercial de langosta del Caribe.
11. Pesca tradicional con línea de mano.
12. Pesca comercial.
13. Pesca deportivo-recreativa de liberación.
14. Restauración ecológica.
15. Protección y conservación ecológica.
16. Monitoreo ecológico.
17. Fondeo de espera sin otra actividad asociada.
18. Recorridos en senderos.

Rule 63.
The activities that will be able to be made in the Park taking care of the zonificación of the same one, are the following ones:

1. Free diving.
2. Diurnal independent diving.
3. Nocturnal independent diving.
4. Tours and/or visits in motorized boats.
5. Tours and/or visits in nonmotorized boats .
6. Boats in transit
7. Videotaping, photographs and sonotaping commercial.
8. Scientific research.
9. Environmental education.
10. Commercial cooperativada fishing of lobster of the Caribbean.
11. Traditional fishing with line of hand.
12. Commercial fishing.
13. Sport-recreational fishing of liberation.
14. Ecological restoration.
15. Protection and ecological conservation.
16. ecological Monitoreo.
17. Anchorage of delay without another associate activity.
18. Routes in footpaths.

1. La instalación o construcción de cualquier tipo de infraestructura temporal o permanente, tanto en la porción terrestre como en la acuática sin el permiso correspondiente.
2. Realizar cualquier tipo y tamaño de fogatas o incendios.
3. Extraer, mover, deteriorar o dañar las embarcaciones encalladas o naufragadas, así como extraer partes de las mismas u objetos que estén o hayan estado dentro de ellas sin las atribuciones legales correspondientes.
4. El hundimiento, varadura o encallamiento intencional de embarcaciones, artefactos navales, estructuras, equipo o cualquier otro tipo de objeto con el fin de crear arrecifes artificiales, sin las autorizaciones correspondientes.
5. Cortar, destruir, mutilar, desmontar o chapear la vegetación existente en el Parque sin la autorización de la SEMARNAT.
6. La colecta de ejemplares, productos o restos de flora y fauna terrestre o acuática, ya sean vivos o muertos, enteros o partes de ellos, nidos y huevos, exceptuando los casos en que exista el permiso correspondiente, emitido por la SEMARNAT.
7. Confinar, cazar, pescar, comercializar, capturar, molestar, dañar o transportar de un lugar -a otro, ejemplares de flora y fauna terrestre o acuática, partes de ellos, nidos o huevos o no liberar a la captura durante la pesca deportivo-recreativa de liberación, por parte de los usuarios, exceptuando los casos en que se cuente con los permisos correspondientes.
8. El uso de anzuelos de acero inoxidable o galvanizado para la pesca deportiva.
9. La introducción de especies de fauna y flora no nativas.
10. Aproximarse a menos de 30 metros de agrupaciones o individuos de aves o reptiles, nidos y realizar actividades que causen alteraciones o perturbación a los mismos, excepto cuando se trate de actividades de investigación científica y se cuente con los permisos correspondientes.
11. Utilizar dardos o compuestos químicos y cualquier otro equipo, sustancia o método que dañe a los organismos de la flora y fauna silvestre, terrestre o acuática, o efectuar cualquier actividad que ponga en riesgo o altere los ecosistemas y sus elementos.
12. Realizar cualquier tipo de fumigación sin el permiso de la Secretaría Estatal de Salud.
13. Verter o descargar en el mar, lagunas, humedales o canales, aguas residuales, aceites, grasas, combustibles, así como abandonar o depositar desechos sólidos, líquidos o cualquier otro tipo de sustancia, con excepción de los desechos orgánicos de productos pesqueros capturados en el Parque.
14. El anclado fuera de las zonas de fondeo de espera en el Parque. En situaciones de emergencia, se procurará anclarse en zonas con fondo arenoso libres de corales, responsabilizándose de que ta embarcación quede fija al fondo, para evitar el garreo del ancla.
15. Cualquier actividad de limpieza de las embarcaciones turísticas, así como de reparación y abastecimiento de combustible de las mismas, o cualquier otra actividad que pueda alterar el equilibrio ecológico del Parque. En caso de emergencia, la reparación de motores que pueda tener como consecuencia derrame de combustibles o aceites, deberá realizarse por lo menos a una distancia de 500 m fuera de las zonas arrecifales.
16. El achicamiento de sentinas dentro del Parque, con excepción de situaciones de emergencia.
17. Realizar actividades de dragado o de cualquier otra naturaleza que generen la suspensión de sedimentos o provoquen la formación de fangos y limos dentro del Parque.
18. Durante la realización de actividades acuáticas queda prohibido pararse, asirse o tocar los arrecifes, usar ~uántes, arrastrar equipo sobre formaciones coralinas, así como remover sedimentos del fondo marino.
19. Durante el desarropo de las actividades turísticas, se prohibe alimentar, perseguir, acosar, molestar o remover de cualquier forma a los organismos terrestres o marinos.
20. Usar bronceadores o bloqueadores solares que no sean biodegradables o no indiquen que si lo son.
21. La pesca con apoyo de aire comprimido o de compresor.
22. La pesca por parte de la tripulación de los prestadores de servicios, los conductores y los usuarios, exceptuando la pesca deportiva de liberación.
23. Desembarcar usuarios, prestadores de servicios, conductores y tripulación de los prestadores de servicios en zonas no designadas para tal fin, salvo en casos de emergencia, reportándose para tal efecto por radio de banda marina al personal del Parque.
24. Usar o transportar cualquier tipo de desecho o residuo considerado por la normatividad ambiental como peligroso conforme a la Norma Oficial Mexicana NOM- 052ECOL-1993 que establece las características de los residuos peligrosos, el listado de los mismos y los limites que hacen a un residuo peligroso por su toxicidad al ambiente.
25. El uso de altavoces, radios (A.M. F.M.), grabadoras, reproductores de discos compactos o equipo de sonido dentro del ANP de manera perceptible en un radio mayor de 50 m a partir de la fuente emisora.
26. A los usuarios, conductores, tripulación de los prestadores de servicios y a los prestadores de servicios, el acceso a los canales o lagunas del Parque, sin el permiso correspondiente.
27. Portar, usar o transportar armas de fuego, municiones o explosivos de cualquier tipo, exceptuando al personal de la SM AM, de la Secretaría de la Defensa Nacional o de policía, siempre y cuando sus elementos se encuentren realizando funciones oficiales dentro dei Parque.
28. Durante las temporadas de agregación reproductiva de especies de escama, queda prohibido el uso de redes y de arpón para su captura.
29. Realizar actividades de remolque recreativo, así como utilizar tablas de vela, tablas de oleaje, embarcaciones menores biplaza, canoas y kayaks sobre las formaciones coralinas.
30. Afianzarse a cualquier tipo de señalización o a boyas que no sean de amarre.
31. La alteración o erradicación de tos pastos marinos.
32. La colecta de materiales y restos arqueológicos e históricos sin la autorización correspondiente.
33. La realización de cualquier actividad no autorizada en el Parque.
34. Usar Jet Skiis
    

Rule 80.
Within the Park it is prohibited:

1. The installation or construction of any type of temporary or permanent infrastructure, as much in the terrestrial portion as in the aquatic one without the corresponding permission.
2. To make any type and size of bonfires or fires.
3. To extract, to move, to deteriorate or to damage the run aground or been shipwrecked boats, as well as to extract parts of the same or objects that are or have been within them without the corresponding legal attributions.
4. The collapse, varadura or intentional encallamiento of boats, naval devices, structures, equipment or any other type of object with the purpose of creating artificial reefs, without the corresponding authorizations.
5. To cut, to destroy, to mutilate, to disassemble or to plate the existing vegetation in the Park without the authorization of the SEMARNAT.
6. It collects it of unit, products or rest of flora and terrestrial or aquatic fauna, or are alive or deads, whole numbers or parts of them, nests and eggs, excepting the cases in that the corresponding permission exists, emitted by SEMARNAT.
7. To confine, to hunt, to fish, to commercialize, to capture, to bother, to damage or to transport of a place - to another one, exemplary of flora and terrestrial or aquatic fauna, parts of them, nests or eggs or not to release to the capture during the sport-recreational fishing of liberation, on the part of the users, excepting the cases in that it is counted on the corresponding permissions.
8. The use of stainless or galvanized steel hooks for the sport fishing.
9. The introduction of species of nonnative fauna and flora.
10. To come near to less than 30 meters of groupings or individuals of birds or reptiles, nests and to make activities that cause to alterations or disturbance to such, except when one is activities of scientific research and it is counted on the corresponding permissions.
11. To use darts or compound chemistries and any other equipment, substance or method that damage to the organisms of the flora and wild, terrestrial or aquatic fauna, or to carry out any activity that puts in risk or alters to the ecosystems and their elements.
12. To make any type of fumigation without the permission of the State Secretariat of Health.
13. To spill or to unload in the residual sea, lagoons, humedales or channels, waters, oils, fats, fuels, as well as to leave or to deposit solid, liquid remainders or any other type of substance, with exception of the organic captured fishing product remainders in the Park.
14. The anchored one outside the zones of delay anchorage in the Park. In emergency situations, it will be tried to anchor in zones with sandy bottom free of chorales,taking responsibility of which ta boat is fixes to the bottom, to avoid I drag of the anchor.
15. Any activity of cleaning of the tourist boats, as well as of repair and supplying with fuel of the same ones, or any other activity that can alter the ecological balance of the Park. In case of emergency, the repair of motors that can have as consequence spill of fuels or oils, will have to be made at least to a distance of 500 ms outside the arrecifales zones.
16. The reduction of wells within the Park, with exception of emergency situations.
17. To make activities of dredged or any other nature that generate the sediment suspension or cause the formation of muds and the slime within the Park.
18. During the aquatic taking of steps it is prohibited to stop itself, to take hold or to touch reefs, to use ~uántes, to drag equipment on formation coralline, as well as to remove sediments of the marine bottom.

24. To use or to transport any type of remainder or remainder considered by the environmental normatividad like dangerous according to the Official Norm Mexicana NOM- 052ECOL-1993 that establishes the characteristics of the dangerous remainders, the listing of such and you limit them that they do to a dangerous remainder by its toxicity to the atmosphere.

29. To make activities of recreational tow, as well as to use tables of candle, tables of surge, shallow-draft vessels two-seater, canoes and kayaks on the formation coralline.
30. To hold fast to any type of signaling or buoys that are not of mooring.
