Las presentes Reglas Administrativas son de observancia general y obligatoria
para todas aquellas personas físicas o morales que realicen actividades
dentro del Parque Nacional Arrecifes de Xcalak, ubicado en la costa
oriental del Municipio Othón P. Blanco, Estado de Quintana Roo.

The present Administrative Rules are of general and obligatory observance
for all those physical or moral people who carry out activities within
the National Park Reefs of Xcalak, located in the Eastern coast of the
Municipality Othón P. Blanco, State of Quintana Roo.

La aplicación de las presentes Reglas corresponde a la Secretaría
de Medio Ambiente y Recursos Naturales, sin perjuicio de las atribuciones
que correspondan a otras dependencias del Ejecutivo Federal de conformidad
con el Decreto por el que se establece el Parque Nacional Arrecifes
de Xcalak, el Programa de Manejo y demás disposiciones legales
aplicables en la materia.

The application of the present Rules corresponds to the Ministry for the
Environment and Natural Resources (Secretaria de Medio ambiente y Recursos
Naturales), without damage of the attributions that correspond to other
dependencies of the Federal Executive in accordance with the Decree by
which it settles down the National Park Reefs of Xcalak, the applicable
Program of Handling and other legal dispositions in the matter. |
Los usuarios, prestadores de servicios, pescadores miembros de las sociedades
cooperativas, pescadores particulares, pasajeros y tripulantes a bordo
de embarcaciones en tránsito y en general todas las personas
que ingresen al Parque, están obligados a cumplir las disposiciones
establecidas en la Ley General del Equilibrio Ecológico y la
Protección al Ambiente, Ley de Aguas Nacionales, Ley de Pesca,
en el Decreto de creación del Parque Nacional Arrecifes de Xcalak,
en el Programa de Manejo, en las presentes Reglas, el POET Costa Maya
y en las demás disposiciones legales aplicables.

The users, service providers, fishermen members of the cooperative societies,
fishing individuals, passengers and crew on board of boats in transit
and in general all the people who enter the Park, are forced to fulfill
the dispositions settled down in the General Law of the Ecological Balance
and the Protection to the Atmosphere, National Water Law, Law of Fishing,
in the Decree of creation of the National Park Reefs of Xcalak, in the
Program of Handling, in the present Rules, the POET Mayan Coast and in
the other applicable legal dispositions. |
En el caso de que por razones de conservación y protección
del Parque, y con base en un sustento técnico adecuado generado
por estudios específicos y/o por los resultados del monitoreo,
los cuales se pondrán a disposición para consulta pública
en las oficinas de la Dirección del Parque, se compruebe que existe
un riesgo inminente de desequilibrio ecológico, la SEMARNAT podrá
limitar cualquier actividad, o bien, en caso de que se determinen condiciones
favorables, su posible incremento, considerando para
tal efecto las propuestas que emita el Consejo Asesor del Parque Nacional
Arrecifes de Xcalak.

If for reasons of conservation and protection of the Park and as a result
of specific studies and/or monitoring, there are good techical arguments
found (outcome which will be made available for public consultation
in the main office of the of the Park), which will verify that an imminent
risk of ecological imbalance exists. The SEMARNAT will be able to increase
or limit any activity, in case that favorable or unfavourable conditions
are determined. The latter taking into consideration the effects of
the proposals that the Advisory Council of the National Park of the
Reefs of Xcalak emits.

Para los efectos de las presentes Reglas Administrativas, además
de las definiciones contenidas en la Ley General de Equilibrio Ecológico
y la Protección al Ambiente, en lo sucesivo se denominará:
- Actividades Turísticas. Aquellas consistentes
en la observación del paisaje, de la flora y la fauna silvestre
en su hábitat natural y cualquier manifestación cultural,
de forma organizada, sin alterar o dañar el entorno natural,
incluyendo el turismo alternativo, mediante la realización
de recorridos y visitas guiadas por guías y/o conductores autorizados
en rutas dentro del Parque Nacional Arrecifes de Xcalak, con el fin
de disfrutar y apreciar sus atractivos naturales, siendo las más
comunes las siguientes: Buceo libre. Es la actividad en la que una
persona combina la natación y la observación de la vida
silvestre subacuática, auxiliada por uno o más de estos
equipos: un tubo con boquilla para respiración o esnorquel,
visor, aletas y chaleco salvavidas;
Buceo autónomo, Es la actividad subacuática que se realiza
con el auxilio de un equipo de respiración autónomo,
tanque con aire comprimido o mezcla de gases, regulador de presión
y chaleco de compensación, además del equipo de buceo
libre; Recorridos ylo visítas. Son las actividades para disfrutar
el paisaje o la observación por medio de senderos de la vida
silvestre terrestre o acuática en embarcaciones motorizadas
o no, las cuales pueden ser de cualquier tipo y dimensión,
cuyo medio de propulsión sea con motores de combustión
interna y/o eléctricos, con transmisión dentro, fuera,
o dentro-fuera de borda.
- Videograbación, fotografía y sonograbación
terrestre o submarina. Son las actividades que se realizan con fines
comerciales o culturales, haciendo aprovechamiento de los recursos
paisajísticos o de las especies de flora y fauna, o bien, acompañando
a los usuarios durante sus actividades para grabar su visita al Parque
con cámaras submarinas o no, de vídeo o fotografía.
- Capacitación. Curso de formación que se imparte con
la finalidad de hacer aptos a los prestadores de servicios turísticos
y/o sus empleados para garantizar el uso sustentable de los ecosistemas
presentes en el Parque.
- CONANP Comisión Nacional de Arcas Naturales Protegidas.
- Conductor o guía. Miembro de la cooperativa turística
y personal de los prestadores de servicios, que a través de
la capacitación y acreditación por parte de SEMARNAT
cuenta con conocimientos suficientes sobre ecología, medio
ambiente, conservación, uso sustentable de los recursos naturales,
así como de aspectos relevantes, culturales y arqueológicos
del Parque Nacional Arrecifes de Xcalak, que desarrolla actividades
y/o servicios de acompañamiento a los turistas y. visitantes
para una mayor satisfacción, entendimiento y disfrute de los
atractivos naturales e históricos del área protegida.
- Consejo. El Consejo Asesor del Parque Nacional Arrecifes de Xcalak,
constituido mediante Acta de fecha - ~- - r , como órgano de
consulta y apoyo, integrado por representantes de los sectores público,
social y privado, con injerencia en el área natural protegida.
- Director. La persona designada por la Secretaría de Medio
Ambiente y Recursos Naturales para llevar acabo las acciones de coordinación,
ejecución y evaluación del Programa de Manejo del Parque
Nacional Arrecifes de Xcalak y del Programa Operativo Anual.
- Embarcaciones en tránsito. Son aquellas que navegan sin
la finalidad de realizar actividades turísticas o de pesca
comercial, dentro del Parque Nacional Arrecifes de Xcalak, para realizar
traslado de personas o transporte de insumos, desechos, residuos o
basura, no importando su punto de origen y destino, y estarán
sujetas a lo dispuesto en las presentes Reglas Administrativas, particularmente
en materia de rutas de navegación y a la zonificación
del Parque.
- Embarcaciones no motorizadas. Son aquellas de propulsión
humana, de vela o de oleaje, dentro de las que se encuentran: kayacs,
pedalonés, canoas, tablas de vela, veleros, tablas de oleaje
en todos sus tipos y dimensiones, colchones de playa con o sin aditamentos
transparentes para la observación de la vida marina.
- Emergencia. Situación que surge de la combinación
de factores diversos, creando sucesos o accidentes naturales o provocados
por actividades humanas que no se esperaban y que ponen en riesgo
o pueden dañar al individuo, la propiedad o al ambiente, por
ejemplo huracanes, accidentes de buceo, derrames de hidro carburos,
entre otros.
- Investigación. Científica. Aquellas actividades que
fundamentadas en el método
científico, conlleven a la generación de información
y conocimiento sobre el Parque
Nacional Arrecifes de Xcalak, desarrolladas por una o varias instituciones
de
educación superior o centros de investigación, organizaciones
no gubernamentales o personas físicas, calificadas como especialistas
en la materia.
- LAN. Ley de Aguas Nacionales y su reglamento.
- LGEEPA. Ley General del Equilibrio Ecológico y la Protección
al Ambiente y su reglamento.
- LP Ley de Pesca y su reglamento.
- Monitoreo. Actividad que,, mediante el registro continuo y sistemático
de los parámetros cuantificables del ambiente o la sociedad
y su evaluación, permite determinar como afecta la realización
de actividades a los diferentes ecosistemas presentes en el Parque.
Permiso, autorización y/o concesión. Al documento que
expide la Secretaría de Medio Ambiente y Recursos Naturales
a través de sus distintas unidades administrativas, por el
que se autoriza la realización de actividades de exploración,
explotación o aprovechamiento de los recursos naturales existentes
dentro del polígono del Parque Nacional Arrecifes de Xcalak,
en los términos de las distintas disposiciones legales y reglamentarias
aplicables.
- Personal. Todo aquel empleado de la Dirección del Parque
Nacional Arrecifes de Xcalak.
- Pescadores. Son las personas físicas o morales que realizan
actividades de pesca dentro del Parque Nacional Arrecifes de Xcalak,
debidamente autorizados por la SAGARPA.
- Prestadores de Servicios Turísticos. A la persona física
o moral que con fines de lucro, se dedica a la organización
de grupos de visitantes que tienen por objeto ingresar al Parque Nacional
Arrecifes de Xcalak con fines recreativos y/o culturales, y que requiere
del permiso otorgado por la Secretaría de Medio Ambiente y
Recursos Naturales, por conducto de la Comisión Nacional de
Áreas Naturales Protegidas.
- PROFEPA. A la Procuraduría Federal de Protección
al Ambiente.
- Programa de Manejo. Deberá sujetarse a las disposiciones
contenidas en la dedaratona del área natural protegida de que
se trate, y tendrá por objeto la administración de la
misma.
- Registro de Permisionarios. Control administrativo de carácter
interno establecido por la Secretaría de Medio Ambiente y Recursos
Naturales, a través del Director del Parque, para disponer
de un padrón de embarcaciones, así como de prestadores
de servicios, pescadores y usuarios que realizan sus actividades dentro
del Parque Nacional Arrecifes de Xcalak, sin ningún costo para
el permisionario.
- Parque. El Parque Nacional Arrecifes de Xcalak, ubicado dentro del
Municipio Othón P. Blanco, Estado de Quintana Roo, con una
superficie total de 17,949 Ha, establecido mediante Decreto Presidencial
publicado en el Diario Oficial de la Federación el 27 de noviembre
de 2000.
- - Reglas. Las presentes Reglas Administrativas.
- SAGARPA. A la Secretaría de Agricultura, Ganadería,
Desarrollo Rural, Pesca y Alimentación.
- SCT. A la Secretaría de Comunicaciones y Transportes.
- SECTUR. A la Secretaría de Turismo.
- SDN. Secretaria de la Defensa Nacional.
- SEA tARNAT. A la Secretaría de Medio Ambiente y Recursos
Naturales.
- SM-AM. A la Secretaría de Marina-Armada de México.
- Turismo Alternativo.Viajes que tienen la finalidad de realizar
actividades recreativas en contacto directo con la naturaleza y con
las expresiones culturales que la envuelven, con una actitud de compromiso
de conocer, respetar, disfrutar y participar en la conservación
de los recursos naturales y culturales.
- Usuarios. Aquellas personas que ingresan al Parque Nacional Arrecifes
de Xcalak, con excepción de los pescadores, para realizar actividades
turísticas, recreativas, culturales, de esparcimiento o de
otro tipo sin fines de lucro, utilizando embarcaciones o cualquier
otro equipo o medio de transporte.
- Zonificación. Sistema mediante el cual se divide el Parque
en zonas geográficas específicas, en atención
a sus caractérísticas ecológicas, ambientales,
de conservación y aprovechamiento, para las que se definen
las actividades y usos permisibles, así como la intensidad
y características de los mismos.

For the effects of the present Administrative Rules, in addition to
the definitions contained in the General Law of Ecological Balance and
the Protection to the Atmosphere, in the succeding piece we will defining
the following:
- Tourist Activities. Those consisting of the observation of the landscape,
the flora and the wild fauna in its natural habitat and any cultural
manifestation, of organized form, without altering or damaging the
natural surroundings, including the alternative tourism, by means
of visits and tours guided by guides and/or conductors authorized
in routes inside the National Park Reefs of Xcalak. These, with the
purpose of enjoying and appreciating its attractive natural resources,
being the most common activities:Free diving: It is the activity in
which a person combines the swimming and the observation of the subaquatic
wild life, helped by one or more of these equipment: a tube with mouthpiece
for breathing or snorkel, mask, fins and life jacket;
Independent diving: Is the subaquatic activity carried out with the
aid of independent breathing equipment, tank with compressed air or
gas mixture, pressure controller and a buoyancy control device, in
addition to the free diving gear. Visits and/or tours: They are the
activities by which one can enjoy the landscape or the observation
by means of on land and aquatic paths, sailing in not/motorized boats.
Boats which can be of any type and dimension, with means of propulsion
such as electrical motors of internal combustion and/or, with transmission,
outside, or up-and-down of hut.
- Videorecording, photographing, terrestrial or submarine soundrecording.
They are the activities carried out with commercial or cultural aims,
taking advantage of the landscaping resources or the species of flora
and fauna, or, accompanying to the users during its activities to
record its visit to the Park with submarine cameras or not, of video
or photographs.
- Qualification. Training courses given with the purpose of educating
the touristic service providers and/or employees in order to make
them capable and guarantee the sustainable use of the present ecosystems
in the Park.
- CONANP: National Commission of Protected Natural Reserves.
- Guides: Member of the tourist and personal cooperative of service
providers, that through the qualification and accreditation on the
part of SEMARNAT count on sufficient knowledge on ecology, environment,
conservation, sustainable use of the natural resources, as well as
of excellent cultural and archaeological aspects of the National Park
Reefs of Xcalak, that develop to activities and/or services of accompanying
and guiding the tourists and visitors with the purpose of a greater
satisfaction, enjoyment and understanding of the beauty of the natural
and the historical resources of the protected area.
- Council. The Advisory Council of the National Reef Park of Xcalak,
constituted by means of the Act of date - ~ - - as consultative agency
and support, integrated by representatives of the public, social and
private sectors with influence in the protected natural area.
- Director. The person appointed by the Ministry of Environment and
Natural Resources (Secretaria of Medio Ambiente y Recursos Naturales)
to oversee the coordination, execution and evaluation of the National
Reef Park of Xcalak's Management Program as well as the Annual Operative
Program.
- Boats in transit. They are those that sail, without the purpose
of carrying out tourist activities or of commercial fishing, within
the National Reef Park of Xcalak, to make transfer of people or transport
of supplies, waste or garbage regardless their point of origin or
destination. The latter will be subject to the present Administrative
Rules, particularly in the matter of routes of navigation and to the
zoning of the Park.
- Non motorized boats. They are those of human propulsion, sail or
motion of the waves. They are: kayacs, pedalonés, canoes, sailing
boards, sailboats, surfing boards in all its types and dimensions,
beach mattresses with or without transparent additions for the observation
of the marine life.
- Emergency. Situation that arises from the combination of diverse
factors, creating events or accidents caused by unexpected human activities
which put the individual at risk or might hurt him, his property or
the environment. For example, hurricanes, diving accidents, spills
of hidrocarbons among others.
- Scientific research. Those activities based on the scientific method
with the purpose of the generation of information and knowledge on
the National Reef Park of Xcalak. These activities are developed by
one or several institutions of
higher education or nongovernmental research centers, or private individuals
who are specialists in the matter.
- LAN:National Water law and its regulation.
- LGEEPA: General law of the Ecological Balance and the Protection
to the Atmosphere and its regulation.
- LP: Fishing law and its regulation
- Monitoreo. Activity that, by means of the continuous and systematic
registration of the quantitative parameters of the atmosphere or the
society and its development, allows to determine the effects that
the various activities have in the park's ecosystems. Permission,
authorization and/or concession: the document issued by the Ministry
of Environment and Natural Resources via its various administrative
units by which by which it is authorized either to conduct exploration
activities or usage of the resources within the polygon of the National
Reef Park of Xcalak under the legal terms and applicable
- Personnel: All the employees working in the Direction of the National
Park Reefs of Xcalak.
- Fishermen. They are the physical or moral people who make activities
of fishing within the National Reefs Park of Xcalak, properly authorized
by the SAGARPA.
- Lenders of Tourist Services. To the physical or moral person who
with profit aims, dedicates his/herself to the organization of groups
of visitors who intend to enter the National Reef Park of Xcalak with
recreational and/or cultural purpose and
that requires of the authorized by the Secretariat of Medio.ambiente
and Recursos Natural, by conduit of the National Commission of Protected
Natural Areas.
- PROFEPA: the Federal Office of the judge advocate general of Protection
to the Atmosphere.
- Program of Handling. It will have to subject to the dispositions
contained in dedaratona of in question protected natural area, and
will intend the administration of the same one.
- Registry of Permisionarios: internal administrative control established
by Secretaria de Medio ambiente y recursos naturales, through the
Director of the Park, to have a register of boats, as well as of lenders
of services, fishermen and users who make their activities within
the National Reef Park of Xcalak, without no cost to the permisionario.
- Park. The National Reef Park of Xcalak, located within the Municipality
Othón P. Blanco, State of Quintana Roo, with a total surface
of 17.949 Has, established by means of Presidential Decree published
in the Official Newspaper of the Federation the 27 of November of
2000.
- - Rules. The present Administrative Rules.
- SAGARPA: To the Ministry of Agriculture, Cattle ranch, Rural Development,
Fish and Feeding.
- SCT. To the Ministry of Communications and Transports.
- SECTUR. To the Ministry of Tourism.
- SDN. Ministry of the National Defense.
- SEMARNAT: To the Ministry of Environment and Natural Resources.
- SM-AM. To the Ministry of Navy-Army of Mexico.
- Alternate tourism: tourism which has the purpose of conducting
recreational activities in direct bonding with the nature and the
cultural expressions that surround it, with an attitude of commitment
to know, respect, enjoy and to participate in the conservation of
the natural and cultural resources.
- Users. Those people who enter the National Reef Park of Xcalak,
with exception of the fishermen, to make tourist, recreational, cultural
or relaxation activities or any other type without profit aims, using
boats or any other equipment or means of transport.
- Zoning: System by means of which the Park is divided in specific
geographic zones based on its ecological and environmental characteristics
with the purpose , of conservation and advantage, for which the permissible
activities and uses are defined, as well as the intensity and characteristics
of such.

Se requerirá de autorización por parte de la SEMARNAT
y/o SAGARPA
para realizar dentro de las áreas naturales protegidas, atendiendo
a las zonas establecidas y sin perjuicio de las disposiciones legales
aplicables, las siguientes obras y actividades:
- Colecta de ejemplares de vida silvestre, así como de otros
recursos biológicos con fines de investigación científica.
- La investigación y monitoreo que requiera de manipular ejemplares
de especies en riesgo

The following works and activities will require authorization, on the
part of SEMARNAT and/or SAGARPA, in order to conduct activities within
the protected natural areas, and taking care that the established zones
and applicable legal dispositions are followed.
- Collection of wild life species as well as of other biological
resources with aims of scientific research.
- The investigation and monitoring that requires the manipulation
of species at risk.

Se requerirá de permiso por parte de la SEMARNAT y/o de SAGARPA
para la realización de las siguientes actividades:
- Prestación de servicios turísticos;
- Acampar o pernoctar en las instalaciones de propiedad federal;
- Pesca deportivo-recreativa de liberación, excepto cua o
- Pesca comercial y acuacultura de fomento; y
- Filmación, videograbación y/o fotografía con
fines comerciales.

It will be required of permission on the part of the SEMARNAT and/or
SAGARPA for the accomplishment of the following activities:
- Benefit of tourist services;
- To camp or to spend the night in the facilities of federal property;
- Sport-recreational fishing of liberation, except cua or commercial
fishing and breeding; and
- Photography, video shooting and/or photograph with commercial aims.

Deberá, presentar un aviso acompañado con el proyecto
correspondiente, al Director, quienes pretendan dearrollar las siguientes
actividades:
- Educación ambiental que no implique ninguna actividad extractiva;
- Investigación sin colecta o manipulación de especímenes
de especies no
considreadas en riesgo;
- Monitoreo sin colecta o manipulación de especímenes
de especies no consideradas en riesgo;
- Filmaciones, actividades de fotografía, la captura de imágenes
o sonidos por cualquier medio, con fines científicos, culturales
o educativos, que requieran de equipos compuestos por más de
un técnico especializado como apoyo a la persona que opera
el equipo principal.
- El aprovechamiento de la vida silvestre, así como el manejo
y control de
ejemplares y poblaciones que se tomen perjudiciales.
- EL aprovechamiento de recursos biológicos 'con fines de
utilización en la
biotecnología.
- Aprovechamiento forestal.
- Aprovechamiento de los recursos pesqueros.
- Obras que, en materia de impacto ambiental,
requieran de autorización en los términos del artículo
28 de la Ley.
- Uso y aprovechamiento de aguas nacionaiés.
- Uso y aprovechamiento de la zona federal marítimo
terrestre
- Prestación de servicios turísticos:
a) visitas guiadas incluyendo el aprovechamiento no extractivo de
vida silvestre.
b) recreación en vehículos terrestres, acuáticos,
subacuáticos y aéreos.
c) pesca deportivo-recreativa.
d) campamentos.
e) servicios de pernocta en instalaciones federales y
f) otras actividades turístico recreativas de campo que no
requieran vehículos.
- Filmación, actividades de fotografía,
la captura de imágenes o sonidos por cualquier medio, con fines
comerciales que requieran de equipos compuestos por más de
un técnico especializado como apoyo a la persona que opera
el equipo principal.
- Actividades comerciales, excepto las que realicen
dentro de la zona de asentamientos humanos, y
- Obras y trabajos de exploración y explotación
mineras.
- Restauración y/o repoblación,
en aquellas áreas terrestres o marinas que lo requieran.
Durante el desarrollo de las actividades a que se refieren las fracciones
anteriores, los interesados deberán respetar lo siguiente:
- Depositar la basura generada en tos lugares señalados para
tal efecto;
- Atender las observaciones y recomendaciones formuladas por el pérsonal
del área
natural protegida, relativas a asegurar la protección y conservación
de los
ecosistemas del área;
- Respetar las rutas, senderos y señalización establecida;
- No dejar materiales que impliquen riesgos de incendios en el área;
- No alterar el orden y condiciones del sitio que visitan;
- No alimentar, acosar o hacer ruidos intensos que alteren a la fauna
silvestre;
- No cortar o marcar árboles o plantas;
- No apropiarse de fósiles u objetos arqueológicos;
- No encender fogatas con vegetación nativa, y
- No alterar los sitios de anidación refugio y reproducción
de especies silvestres

A warning accompaning the project proposal should be presented to the
Director if the following activities wish to be performed:
- environmental Education that does not imply
any extractive activity;
- Investigation without collection or manipulation
of species not
considered at risk;
- Monitoring without collection or manipulation
of species not
considered at risk;
- Shootings, activities of photography, the capture
of images or sounds by any means, with scientific aims, cultural or
educative, that require of equipment made up of more of a technician
specialized like support the person who operates the main equipment.
- The usage of the wild life, as well as the handling
and control of
unit and populations that take themselves detrimental.
- The usage of biological resources with aims
of use in the
biotechnology.

- The usage of the fishing resources.
- Works that, in the matter of environmental impact,
they require authorization in the terms of article 28 of the Law
- Water use and national waters.
- Use and advantage of the terrestrial marine
federal zone
- Benefit of tourist services:
a) visits guided including the nonextractive advantage of wild life.
b) recreation in terrestrial, aquatic, subaqueous and aerial vehicles.
C) it fishes sport-recreational.
d) campings.
e) services of spends the night in federal facilities and
f) other recreational tourist activities in the field that do not
require vehicles.
- Shooting, activities of photography, the capture
of images or sounds by any means, with commercial aims that require

- Commercial activities, except which they make
within the zone of slumses, and
- Works and works of mining exploration and operation.

- not to feed, to harass or to make noises intense that
alter to the wild fauna;
- not to cut or to mark to trees or plants;
- not to take control of fossils or archaeological objects;
- not to ignite bonfires with native vegetation, and
- not to alter to the anidación sites refuge and
reproduction of wild species

Se requerirá de concesión por parte de SAGARPA para la
realización de las siguientes actividades:
- Pesca y acuacultura comercial.

It will be required of concession on the part of SAGARPA for the accomplishment
of the following activities:
- Fishing and commercial hydroculture.

Para la obtención de las autorizaciones a que se refiere prestación
de servicios turísticos en la Regla 6, el promovente deberá
presentar una solicitud que cumpla con los siguientes requisitos:
- Nombre o razón social del solicitante,
nacionalidad (acta de nacimiento), domicilio para oír y recibir
notificaciones, número de teléfono y fax, en su caso,
copia de una identificación oficial o acta constitutiva de
la sociedad y poder para actos administrativos;
- Tipo y características del o los vehículos
que se pretendan utilizar para la realización de la actividad,
en el caso de embarcaciones se deberá anexar los certificados
de registro y una fotografía de la misma; si son embarcaciones
similares presentar una sola fotografía, indicando el número
total;
- Descripción de la actividad;
- Duración de la actividad;
- Programa de actividades a desarrollar, en el
cual se incluyan períodos, horarios de salida y regreso, tiempo
de estancia en el Parque y ubicación de la zona de manejo donde
se pretendan llevar a cabo dichas actividades:
- Número de visitantes, 8 personas ¡Ha/hora;
- Las características del equipo que se
utilizará;
- Para personas físicasy/o morales, póliza
de seguros de viajero y tripulante;
- Especificación y manejo de los desechos
orgánicos e inorgánicos generados durante los recorridos;
y
- Acreditar el pago de derechos correspondiente,
bajo los términos establecidos en la Ley Federal de Derechos.
Todos los documentos deberán ser entregados por
duplicado a la Dirección del Parque, dirigidos al Presidente
de la Comisión Nacional de Areas Naturales Protegidas, con domicilio
en Camino al Ajusco # 200, Ala Norte, 3er Piso, Jardines de la Montaña.

For the obtaining of the authorizations rgarding the tourist services
mentioned in Rule 6 , the promotor will have to present/display a request
that fulfills the following requirements:
- Name or trade name of the applicant, nationality
(birth certificate), address to hear and to receive notifications,
telephone number and fax, in its case, copies of an official identification
or incorporation papers of the society and power for administrative
acts;
- Type and characteristics of the vehicle or vehivles
that are intended to be used forr the accomplishment of the activity.
In the case of boats, a copy of the title deed and a photograpf of
the boat/s in question will have to be annexed. If they are similar
boats, a single photograph indicating thtotal number of them will
have to be presented/displayed.
- Description of the activity;
- Duration of the activity;
- Plan of the activities to be acomplished, in
which periods, schedules of exit and return are included as wekk as
time of stay in the Park and location of the zone in which the activities
are intended to be carried out.
- Number of visitors, 8 people per Ha/hr
- The characteristics of the equipment that will
be used;
- For private people or companies, an insurance
policy of traveller and crew member is requeired;
- Specification of the handling of the generated
organic and inorganic waste created during the routes; and
- To credit the payment of the corresponding rights,
under the terms established in the Federal Law of Rights.
All the documents will have to be given by duplicate to
the Direction of the Park, directed to the President of the National
Commission of Protected Natural Areas, with address in: Camino al nr.
200, Ala Norte, 3er. piso, Col. Jardines de la Montana, C.P.14210. Mexico,

Las autorizaciones otorgadas con anterioridad al presente documento son
de carácter temporal y su vigencia es la que estipula el propio
documento. A partir de la entrada en vigor del presente Programa de Manejo
y del Reglamento de la Ley General del Equilibrio Ecológico y ta
Protección al Ambiente en Materia de Areas Naturales Protegidas,
el otorgamiento o refrendo del permiso, deberá solicitarse en el
periódo de abril a septiembre de cada año, ante la CONANP.

The authorizations granted prior to the present document are of temporary
character and its use is the one that stipulates the own document. From
the moment that the present Program of Handling and the Regulation of
the General Law of the Ecological Balance and ta Protection to the Atmosphere
in the matter of Protected Natural Areas takes effect, the granting or
countersignature of the permission will have to be asked to the CONANP
in the period of April to September of every year. |
Las autorizaciones para la prestación de servicios turísticos,
deberán solicitarse con una antelación de 30 días
naturales al inicio de las actividades y, como se estipula en el Art.
98 del Reglamento de la LGEEPA en materia de ANP"s, el período
de recepción de solicitudeses entre abril y septiembre. |
The authorizations for providing touristic services, will have to be
asked for, 30 days prior to the beginning of the activities and as it
is stipulated in Art. 98 of the Regulation of the LGEEPA in the matter
of ANP"s. The period of reception of applications is between April
and September.

La SEMARNAT otorgará o negará el permiso dentro de un plazo
de 30 días hábiles, contados a partir de la fecha en que
se presente la solicitud. Una vez transcurrida dicha fecha sin que medie
respuesta por parte de ésta, se entenderá negado' el permiso
solicitado.

The SEMARNAT will authorize or deny the leave within a term of 30 working
days, counted as of the date in which the request appears. Once this date
has passed without having received an answer from the SEMARNAT, it can
be understood as denial of the permission. |
Sólo podrán utilizar las instalaciones del Parque, aquellos
prestadores de servicios recreativos que cuenten con el permiso o autorización
expedido por ta SEMARNAT, y dependerá de las acciones operativas
de la Dirección y calendarios propuestos por los prestadores de
servicios para la disponibilidad de espacios.

They will only be able to use the facilities of the Park, those providers
of recreational services that count on the permission or authorization
sent by the SEMARNAT, and will depend on the operative actions of the
Direction and calendars proposed by the providers on services for the
availability of spaces. |
Para el otorgamiento de las autorizaciones a que se refiere a filmaciones,
actividades de fotografía o captura de imágenes y sonidos
a la que se refiere la Regla 6, el solicitante deberá presentar
una solicitud que cumpla con los siguientes requisitos:
- Nombre o razón social del solicitante,
domicilió para oír y recibir notificaciones, número
de teléfono y fax, en su caso, y copia de una identificación
oficial o acta constitutiva de la sociedad o asociación;
- Datos del responsable del desarrollo de las
actividades;
- Tipo y características del los vehículos
que se pretendan utilizar para la realización de la actividad;
- Programa de actividades a desarrollar, en el
cual se incluya, fecha, horarios de ingreso y salida, tiempo de estancia
en el área natural protegida y ubicación del área
o nombre de las localidades donde se pretendan llevar a cabo dichas
actividades;
- Número de personas auxiliares;
- Tipo de equipo a utilizar para ta actividad;
- Carta de exposición del tipo de filmación,
videograbación ylo tomas fotográficas indicando el fin
de las mismas; y
- Acreditar el pago de derechos correspondiente,
en su caso, de acuerdo a lo establecido por la Ley Federal de Derechos
vigente.
Todos los documentos deberán ser entregados por
duplicado a la Dirección del Parque, dirigidos al Director de
la CONANP, con domicilio en, Camino at Ajusco # 200, Ala Norte, 3er

For the granting of the authorizations such as filming activities ,
photography or capture of images and sounds to which Rule 6 talks about,
the applicant will have to present/display a request that fulfills the
following requirements:
- Name or trade name of the applicant, domiciled
to hear and to receive notifications, telephone number and fax, in
its case, and copies of an official identification or incorporation
papers of the society or association;
- Data of the person in charge of the development
of the activities;
- Type and characteristics of or the vehicles
which are intended to be used for the accomplishment of the activity;
- Program of activities to be developed, in which
it is included, date, schedules of entrance and exit, time of stay
in the natural area protected and location of the area or names of
the localities where they activities are to be carried out;
- Number of auxiliary people;
- Type of equipment to use for the activity;
- Letter of exhibition of the type of filming,
videofilmingand/or photography takings indicating the aim of the same
ones; and
- To credit the payment of the corresponding rghts,
in its case, according to the established by the effects of the Federal
Law of Rights.
All the documents will have to be given by duplicate to

Los permisos a que se refiere la Regla anterior deberán solicitarse
con una antelación de 30 días naturales al inicio de las
actividades. La SEMARNAT por conducto de la CONANP otorgará o negará
el permiso dentro de un plazo de 10 días hábiles, contados
a partir de la fecha en que se presente la solicitud. |
The permissions mentioned in the previous Rule will have to be asked for
30 days prior to the beginning of the activities. The SEMARNAT by conduit
of the CONANP will authorize or deny the leave within a term of 10 working
days, counted as of the date in which the request appears. |
Para el otorgamiento de los permisos, la CONANP tomará en cuenta
la calidad del servicio y el cumplimiento de los requisitos señalados
en la Regia 15.

For the granting of the permissions, the CONANP will take into consideration
the quality of the service and the fulfillment of the requirements indicated
in Rule 15. |
Si el interesado presenta en tiempo y forma el informe final de actividades
y cumple con las obligaciones especificadas en el permiso que le fue otorgado
con anterioridad, automáticamente le será concedido el refrendo
correspondiente.

If the interested one presents/displays and forms the closing report of
activities in time as well as fulfills the obligations specified in the
permit that was granted to to him previously, then the corresponding countersignature
will be granted to him automatically. |
El refrendo de los permisos deberá solicitarse a mas. tardar
el 30 de abril de cada año, durante la vigencia del permiso,
ante la CONANP, y estará sujeto a:
- La evaluación del comportamiento del
permisionario con base en la tabla de sanciones durante la temporada
anterior.
- La presentación en tiempo y forma del
informe final de actividades ante la CONANP, mismo que deberá
entregarse a mas tardar el 30 de abril de cada año. La no presentación
de dicho informe durante el periodo establecido podrá ser sancionada
con la cancelación o el no refrendo del permiso.
- Al cumplimiento por parte del permisionario
de los lineamientos y condicionantes establecidos en el permiso correspondiente,
y
- A la evaluación técnica que realice
la CONANP, mediante el análisis de su situación particular.
Durante el año administrativo los permisionarios
que no efectúen el trámite de refrendo ante la CONANP
en el plazo establecido, perderán el derecho de obtenerlo por
ese solo
hecho. |
The countersignature of the permissions will have to be asked for at
the latest on the 30th of April of every year and during the validity
period of the permission. The request will have to be asked to the CONANP,
and will be subject to the following:
- The evaluation of the behavior of the permisionario,
based on the table of sanctions, during the previous season.
- The in time presentation of the the closing
report of activities before the CONANP, same that will have to handed
in by the latest on the the 30 of April of every year. The presentation
of this report during the established period could not be sanctioned
with the cancellation or the noncountersignature of the permission.
- To the fulfillment on the part of the permisionario
of the allingments and conditions established in the corresponding
permission, and
- To the technical evaluation that the CONANP
makes, by means of the analysis of its particular situation.
During the administrative year the permisionarios that
do not carry out the countersignature proceeding before the CONANP in
the established term, will lose the right to obtain it by that single
one
fact. |

Los prestadores de servicios y pescadores deberán proporcionar
el apoyo y facilidades necesarias al personal de la SEMARNAT en las labores
de inspección, vigilancia y protección del, Parque, así
como en asuntos de interés común y en cualquier situación
de emergencia o contingencia.

The service providers and fishermen will have to provide the support and
necessary facilities to the personnel of the SEMARNAT in their work of
inspection, monitoring and protection of the Park, as well as in subjects
of common interest and any situation of emergency or contingency. |
Queda prohibido el consumo de bebidas alcohólicas, tóxicos,
drogas, estimulantes o cualquier compuesto o sustancia ilegal.
|
The consumption of spirits, toxic, drugs, stimulating substances or any
illegal substance is prohibited. |
En los casos de contingencia ambiental o de emergencia ecológica:
- Se estará a lo dispuesto por los Capítulos
II del Título Primero y Ill del Título Sexto de la Ley
General del Equilibrio Ecológico y la Protección al
Ambiente,
- El Director del Parque se mantendrá en estrecha coordinación
con la SCT a través de sus Capitanías de Puerto en Chetumal,
Xcalak y Mahahual, la SMAM, la SON, la PROFEPA y las demás
instancias involucradas, para garantizar la seguridad de los usuarios
del Parque y tomar las decisiones que le correspondan en el marco
de las disposiciones legales aplicables.
- En los casos en que entre en acción el Sistema Estatal de
Protección Civil, el
Director del Parque se coordinará con la Dirección Municipal
competente para dichos
casos.

In the cases of environmental contingency or ecological emergency:
- one will be to disposition by the Chapters II
of the Title the First and III of the Title Sixth of the General Law
of the Ecological Balance and Protection to the Atmosphere,
- The Director of the Park will stay in narrow coordination with
the SCT through his Harbor authorities in Chetumal, Xcalak and Mahahual,
the SMAM, IS it, the PROFEPA and the other involved instances, to
guarantee the security of the users of the Park and to make the decisions
that correspond to him within the framework of the applicable legal
dispositions.
- In the cases where the State System of Civil defense is put into
action, the
Director of the Park will work in coordination with the competent
Municipal Authority in those specific cases.

Todas las embarcaciones que ingresen al parque deberán cumplir
cabalmente con las disposiciones de la SCT, conforme a lo indicado en
el Certificado Nacional de Seguridad Marítima correspondiente,
tratándose de embarcaciones extranjeras éstas deberán
cumplir con las disposiciones legales aplicables en la materia.

All the boats that enter the Park will have to strictly fulfill the dispositions
of the SCT, according to what is indicated in the National Certificate
of Marine Security. All the foreign boats will have to fulfill the applicable
legal dispositions in the matter. |
Los usuarios, conductores, tripulación de los prestadores de servicios,
pescadores y prestadores de servicios deberán respetar la señalización,
boyas o balizas, establecida conjuntamente por la SCT, a través
de las Capitanías de Puerto de Chetumal, Xcalak y Mahahual: y SEMARNAT
por conducto del Director del Parque.

The users, conductors, crew of the providers of services, fishermen and
service providers will have to respect the signaling, buoys or beacons,
settled down jointly by the SCT, through the Harbor authoritieses of Chetumal,
Xcalak and Mahahual: and SEMARNAT by conduit of the Director of the Park.
|

Todas las boyas y señalizaciones son propiedad federal y su instalación,
reubicación, remoción y mantenimiento se hará mediante
la coordinación de la Dirección dei Parque con la SCT, a
través de la Dirección General de Marina Mercante.
|
All the buoys and signalings are federal property. Their installation,
relocation, removal and maintenance will be done by means and under the
coordination of the Direction of the Park together with the SCT, through
the Main directorate of Merchant marine. |
A partir de los 200 m de distancia a las boyas de amarre, así como
en los
canales, la velocidad máxima de navegación es de 4 nudos
o sin provocar oleaje. |
From the 200 ms of distance to the mooring buoys, as well as in
channels, the maximum speed of navigation is of 4 knots or without causing
waves. |
Si las boyas de amarre se encontraran ocupadas, el personal de la embarcación
optará por buscar otro sitio de amarre, o en su caso, esperará
a más de 50
m de distancia de la zona boyada hasta que se desocupe algún sitio,
o bien, si ambas
embarcaciones son menores, solicitará al patrón de alguna
embarcación hecha firme a una boya, permiso para amarrarse en la
misma.

If the mooring buoys were to be occupied, the personnel of the boat will
look for another site of mooring, or will wait at minimum 50 mtrs of distance
from the buoy zone until the buoy is free. If both boats are small permission
can be asked to moore the boat in the same place. |
Los usuarios, conductores, prestadores de servicios y su tripulación,
así
como los pescadores deberán comunicar al Director de cualquier
daño al boyen o señalización que sea causado como
resultado de cualquier tipo de acción.

The users, conductors, service providers and their crew, as well as the
fishermen must communicate to the Director of any damage to the buoys
or signaling that is caused as a result of any type of action. |
La Dirección del Parque en coordinación con las autoridades
competentes realizará operativos de control sanitario y toxicológico
en cualquier momento, con la finalidad de preservar las mejores condiciones
de aprovechamiento sustentable de los recursos del Parque.

The Direction of the Park in coordination with the competent authorities
it will, at any time, carry out sanitary and toxicological controls, with
the purpose of preserving the best conditions of sustainable advantage
of the resources of the Park. |
El número permitido de usuarios por conductor es 8 buzos/Ha/hora.
|
The allowed number of users per guide is 8 divers /Ha/hour. |
El horario para realizar actividades turísticas en el Parque será
de las 7:00 a las 17:00 horas durante el horario de invierno y de las
7:00 a las 18:00 horas durante el horario de verano, exceptuando el buceo
autónomo nocturno, las visitas guiadas para la observación
de aves y las actividades turísticas que se realicen en zonas de
uso restringido.

The time schedule to perform touristic activities in the Park will be
from the 7:00 to 17:00 hours during the winter season and of the 7:00
to 18:00 hours during the summer season, with the exception of nocturnal
independent diving, the visits guided for the observation of birds and
tourist activities that are carried out in zones of restricted use. |
Buceo libre y autónomo:
- Las actividades de buceo libre y autónomo solamente serán
con fines de observación, y se deberán realizar a una
distancia mínima de 2.5 m de las formaciones coralinas. Conservar
esta distancia es responsabilidad del conductor o guía.
- En la práctica del buceo libre o autónomo, únicamente
el conductor o guía podrá portar cuchillo. Queda prohibido
el uso de guantes.
- Queda prohibido todo tipo de pesca dentro de los límites
del Parque a los prestadores de servicios turísticos, exceptuando
la pesca deportivo-recreativa de liberación, previo permiso
expedido por la SEMARNAT.

Free and independent diving:
- The activities of free and independent diving will only have observation
purposes and they will have to be performed at a minimum range of
2,5 mtrs. from the coral formation and this is the responsibility
solely of the guide.
- In the practice of free or independent diving only the guide will
be able to carry a knife. It is prohibited the use of gloves.
- It is prohibited, to all touridtic service providers, all type
of fishing within the limits of the Park, with the exception of the
recreational-sport of liberation and with previous permission granted
by the SEMARNAT.

Buceo libre:
- Es obligatorio para todos los usuarios y conductores, la utilización
de chalecos salvavidas que eviten que los usuarios se paren en los
corales, durante el desarrollo de esta actividad.
- El número máximo permitido de usuarios por conductor
es de 8 y 4 en las zonas de uso restringido.

Free diving:
- The use of life jackets is compulsory for all the users and guides.
This in order to prevent that people stand on the coral while diving.
- the allowed maximum number of users by guide is of 8 and 4 in the
areas of restricted use.
|
Buceo autónomo:
- Sólo se podrá realizar con fines de observación
y siempre bajo la supervisión de un conductor que cuente con
el certificado otorgado por organizaciones de buceo autónomo
reconocidas internacionalmente, como: FMAS, CMAS, NAUI, PADI, entre
otras.
- Se debe verificar que el punto sobre el fondo marino a donde llegue
la línea de descenso, está a un mínimo de 15
m de las formaciones coralinas, para que no destruya a la flora y
fauna marinas, tomando en cuenta que por corriente o viento, las embarcaciones
pueden cambiar de posición.
- El conductor podrá llevar un máximo de 6 usuarios
en buceo autónomo diurno, 3 cuando se realice en zonas de uso
restringido; y 4 usuarios en buceo autónomo nocturno, el cual
no podrá realizarse en las zonas de uso restringido.
- El- prestador de servicios de buceo autónomo debe proporcionar
a los usuarios el equipo de seguridad necesario para realizar esta
actividad y sujetarse a lo establecido en la Norma Oficial Mexicana
NOM-05-TUR-1995.
- Es obligatorio para todos los usuarios y conductores la utilización
de chalecos compensadores de flotación durante el desarrollo
de la actividad.
- Todo usuario que realice actividades de buceo autónomo en
la zona de uso restringido y la poza deberá contar con la certificación
correspondiente, válida ante organizaciones nacionales o internacionales.
- El buceo nocturno sólo podrá ser realizado por los
usuarios que cuenten con la certificación de buceo que avale
los estándares de seguridad para esta actividad.
- El buceo nocturno sólo podrá realizarse entre las
19:00 y las 22.00 horas.

Independent diving/scuba diving:
- It will only be possible if with observation purposes and under
the supervision of a guide who has the certificate granted by independent
diving organizations which are internationally recognized, such as:
FMAS, CMAS, NAUI, PADI, among others.
- It has to be verified that the point on the marine bottom to where
the line of descent arrives, is to a minimum of 15 mtrsaway from the
coral formation. This to ptrvent the destruction of the marine flora
and fauna. ALso it has to be taken into account that by current or
wind, the boats can change of position.
- The guide will be able to take a maximum of 6 divers in diurnal
independent/scuba diving, 3 when the diving is areas of restricted
use and 4 users in nocturnal independent/scuba diving. The latter
will not be able to be made in the zones of restricted use.
- The providers of independent/scuba diving services must provide
the users with the security equipment necessary for carrying out the
activity. The providers of the service will also have to do stick
to what is established in the Official Mexican Norm NOM-05-TUR-1995.
- It is obligatory for all the users and guides the use of buoyancy
vests while carrying out the activityd.
- All user who makes activities of independent/scuba diving in the
zone of restricted use and the poza will have to have the corresponding
valid certification for national or international organizations.
- The nocturnal diving will only only be performed by the users who
posses the certification of standard diving that guarantees the security
for this activity.
- The nocturnal diving will only be able to take place between 19:00
and the 22:00 hours.

La pesca deportiva dentro de los limites del Parque, se llevará
a cabo de conformidad con las disposiciones contenidas en la LP, su reglamento
y las normas oficiales mexicanas aplicables y en todos los casos deberá
ser de liberación, utilizando los equipos diseñados especialmente
para degradarse en el corto plazo.

Sport fishing within the limits of the Park, willhave to be be carried
out in accordance with the dispositions contained in the LP, their regulation
and the applicable Mexican official norms and in all the cases will have
to be of liberation, using the equipment designed specially to degrade
itself in the short term. |
Durante los recorridos de actividades turísticas:
- Cada grupo integrado por uno o más usuarios deberá
utilizar de preferencia, los servicios de un conductor.
- La velocidad máxima será de 4 nudos en los canales
y las áreas de buceo:
- Las visitas guiadas para la observación de aves se realizarán
en embarcaciones no motorizadas tipo canoa con capacidad para tres
personas, incluido el conductor, exclusivamente en las zonas asignadas
para esa actividad y en un horario de 6:00 a 18:00 Hrs.

During the trips of tourist activities:
- Each group integrated by one or more will havepreferably use the
services of a guide
- The maximum speed will be of 4 knots in the channels and the diving
areas:
- The tours guided for the observation of birds will be made in nonmotorized
boats type canoe with capacity for three people, including the guide,
exclusively in the zones assigned for that activity and in a schedule
of 6:00 to 18:00 Hrs.

Los prestadores de servicios se obligan a proporcionar a los usuarios
las condiciones de seguridad necesarias para realizar las actividades
para las cuales contraten sus servicios, de acuerdo a la legislación
aplicable en la materia.

The providers of services must commit themselves to provide the users
with the security conditions necessary to make the activities for which
they contract the services. This according to the applicable legislation
in the matter. |
Los prestadores de servicios turísticos que pretendan desarrollar
actividades recreativas yio utilizar las instalaciones del Parque deben
contar con el permiso correspondiente emitido por la SEMARNAT a través
de la CONANP.

The providers of touristic services that intend to carry out recreational
activities and/or to use the facilities of the Park must have the corresponding
permission emitted by the SEMARNAT through the CONANP. |
Están obligados a informar a los usuarios que están ingresando
a un área natural protegida, así como las condiciones para
visitarla; y divulgar la versión oficial condensada de las Reglas
Administrativas a bordo de las embarcaciones, pudiendo apoyar esa información
con el material gráfico y escrito autorizado por la Dirección
del Parque.

They are forced to inform to the usuary they are entering a protected
natural area , as well as the conditions to visit it.Also they have to
disclose the official summarised version of the Administrative Rules on
board of the boat They also have to be able to support that information
with authorized graphical and written material by the Direction of the
Park. |
Deben asegurarse que el personal y la tripulación responsables
de la atención a los usuarios, que funjan como conductores o guías,
asistieron y acreditaron los cursos que sobre esta actividad en áreas

de los ecosistemas existentes en el Parque, su importancia y las medidas
de conservación implemente la SEMARNAT a través de Dirección
del Parque.

For the rendering of tourist services they will have to designate a conductor
or guide, who during the accomplishment of his activities will have to
carry the accreditation as guide issued by the Ministry of Tourism. Also
he/she will have to have passed the advanced training courses on the characteristics
of the Par's existing ecosystems in the its importance and the measures
of conservation implemented by the SEMARNAT through the Direction of the
Park. |
Los guías que presten sus servicios dentro del Parque deberán
estar inscritos en el Registro, así como cumplir con lo establecido
en la NOM-08-TUR-1 996 y NOM- 09-TUR-1 997. Dicha inscripción se
hará de oficio por parte de la Dirección del

The guides who work within the Park will have to be enrolled in the Registry,

servicios, cumplan con lo establecido en las presentes Reglas Administrativas.

En casos de daños al sistema de boyen o señalización
por parte de la tripulación, conductor o de los usuarios que transporten,
el prestador de servicios será responsable de su reparación.

In cases of damages to the buoy system signaling on the part of the crew,
conductor or of the users transported, the provider of the service will
be responsible for its repair. |
El permisionario deberá participar en las reuniones que convoque
la Dirección del Parque, donde se analizará la problemática
del área protegida y sus alternativas de solución, debiendo
sujetarse a los acuerdos y criterios concertados y asentados en la minuta
que al efecto se elabore.

The permisionario will have to participate in the meetings that the Direction
of the Park summons, where the problematic of the protected area and its
alternatives solutions will be analysed. This will be done complying with
the agreements and criteria arranged and seated in the draft that to the
effect is elaborated. |
Durante la realización de actividades turísticas dentro
del Parque, el personal de los prestadores de servicios deberá
portar en forma visible la identificación expedida por la Dirección.

During the rendering of touristic services within the Park, the personnel
of the service provider will have to carry in visible form the identification
sent by the Direction. |
Los prestadores de servicios recreativos deberán contar con un
seguro de responsabilidad civil o de daños a terceros, con la finalidad
de responder por cualquier daño o perjuicio que sufran en su persona
o en sus bienes los visitantes, así como de los que sufran tos
vehículos y equipo, o aquellos causados a terceros durante su estancia
y desarrollo de actividades en el Parque.

The lenders of recreational services must have an insurance of civil responsibility
or damages to third parties, with the purpose of being responsible for
any damage the visitors migh cause or any damage they might undergo or
their belongings. Also for the damage that the vehicled and or equipment
migh suffer or he damage caused to third parties during their stay and
development of activities in the Park. |
Los prestadores de servicios turísticos, su tripulación
o conductores, en caso de observar alguna violación o incumplimiento
a estas Reglas Administrativas, algún acontecimiento o acción
provocada por el hombre que ponga en peligro la integridad o altere las
condiciones naturales de los ecosistemas del Parque, o la seguridad de
los usuarios, deberá notificar inmediatamente a la Dirección
del Parque o a la PROFEPA, quien podrá suspender la realización
del servicio de conformidad con las disposiciones legales aplicables.

If any service provider or their crew and guides observe some violation
or breach of these Administrative Rules by some event or action by someone
who will put in danger either the integrity of the natural conditions
of the park or alters them natural conditions of the ecosystems of the
Park and/or the security of the users, will have to notify it immediately
to the Direction of the Park or the PROFEPA so that the PROFEPA is able
to, suspend the accomplishment of the service in accordance with the applicable
legal dispositions. |

El aprovechamiento de langosta del caribe (Panulirus argus) se realizará
exclusivamente conforme a las temporadas de captura y cuotas determinadas
por la SAGARPA mediante autorización.

En el Parque sólo podrán pescar langosta del caribe, dentro
de las zonas establecidas para tal efecto, los pescadores cooperativados
que cuenten con el permiso O concesión expedido por la SAGARPA,
bajo les términos y condicionantes establecidos.

In the Park it will only be allowed to fish lobster of the Caribbean
within the zones
established
for
such
effect,
and only by the fishermen
who belong to the "cooperativa"and who
count with a permit or concession sent by the SAGARPA. They will also
have to stick to settled down terms and conditions. |
Los pescadores no organizados en cooperativa que cuenten con el permiso
otorgado por la SAGARPA y que realicen pesca de escama, deberán
hacerlo bajo los términos establecidos en el permiso o autorización
correspondiente.

The fishermen who do not belong to a "cooperativa"but that have a permit
authorized by the SAGARPA and thatpractice grudge
fishing,
will
have
to fish
under the terms settled down in the permission or corresponding authorization.

Los pescadores sólo podrán utilizar las artes y equipos
de pesca autorizados por la SAGARPA para las especies de la langosta del
caribe y escama. Queda prohibido el uso de aire comprimido como apoyo,
ya sea en buceo o con compresor para las actividades pesqueras.

For the fishing of lobster of the Caribean and grudge fishing, the fishermen
will only be able to use the arts and equipment for fishing which is
authorized
by the
SAGARPA
. The use of compressed air as an aid for diving and/or the use of
a compressor for fishing activities is prohibited. |
La utilización de artes de pesca de atajo deberá sujetarse
a las condicionantes establecidas en los permisos correspondientes, prohibiéndose
el uso de artes o equipos de pesca complementarios.

The use of arts of short cut fishing will have to be subject to the conditions
established in the corresponding permissions, prohibiting the use
of arts
or complementary equipment of fishing. |
No se permitirá el establecimiento de nuevas trampas de atajo hasta
que existan estudios técnicos que justifiquen su sustentabilidad.

The establishment of new traps of short cut fishing will not be allowed
until technical studies exist that justify their support.

Las trampas de atajo autorizadas deberán revisarse con la periodicidad
establecida en el permiso correspondiente.

The authorized traps for short cut fishing will have to be reviewed
with the regularity established in the corresponding permit. |
En caso de observar alguna violación o incumplimiento a estas Reglas
así como algún acontecimiento o acción provocada
por el hombre que ponga en peligro la integridad de las personas o altere
las condiciones naturales del Parque, deberán reportarlo inmediatamente
al personal del Parque o a la PROFEPA los cuales, según el caso,
podrán solicitar el retiro de dichos pescadores del polígono
del Parque.

In case anyone observes some violation or breach of the Rules
as well as any event or action caused by men, who puts the
integrity of
the people in danger
or alters the natural conditions of the Park, will have
to report it immediately to the personnel of the Park or the PROFEPA
who,
according to the case, will be able to ask the offender/s to leave the
Park's polygon. |
En casos de daño al sistema de boyen o señalización
por negligencia de los pescadores, los involucrados directamente en el
evento serán los responsables de reparar los daños ocasionados.

In cases of any damage to the system of buoys or signaling caused by
negligence on the part of the fishermen, the involved ones directly
in the event will be made responsible for the repair
of the damages. |
Queda prohibido realizar dentro del Parque cualquier actividad de limpieza
de las embarcaciones con sustancias químicas nocivas o cualquier
otra actividad que pueda alterar el equilibrio ecológico del
mismo, a menos de que cuenten con el equipo e infraestructura adecuados
y aprobados
por la Dirección del Parque. En caso de emergencia, la reparación
de motores u otros equipos que puedan tener como consecuencia derrame
de combustibles o aceites, deberá realizarse por lo menos a una
distancia de 500 metros de las zonas arrecifales.

Inside the park It is prohibited to carry out any activity of cleaning
of the boats with hazardous chemical substances or any other
activity that
can
alter the ecological balance of the park. Unlesso, the person has
the equipment and infrastructure suitable and approved by the Direction
of the Park. In case of emergency, the repair of motors or other equipment
that can have as consequence spill of fuels or oils, will have to be
made
at least at a distance of 500 meters of the reef zones. |
Los representantes legales de la sociedad cooperativa deberán participar
en las reuniones que convoque la Dirección del Parque, donde se
analizará la problemática del área protegida y sus
alternativas de solución, debiendo sujetarse a los acuerdos y criterios

Tomando en consideración que °un Parque Nacional tiene por
objeto preservar los ambientes naturales representativos de las diferentes
regiones
biogeográficas y ecológicas y de los ecosistemas más
frágiles, para asegurar el equilibrio y la continuidad de los
procesos evolutivos ecológicos; salvaguardar la diversidad genética
de las especies silvestres, en particular las que están en peligro
de extinción, las amenazadas, las endémicas, las raras
y las que se encuentran sujetas a protección especial y asegurar
el aprovechamiento sustentable de los ecosistemas y sus elementos, los
usos y aprovechamientos que se pretendan realizar en el Parque, estarán
determinados de acuerdo a la siguiente zonificación:
Zonas de Uso Restringido y de Protección:
Definidas con el acuerdo del sector pesquero y la Comunidad
- Zona de Uso Restringido Río Huach. Comprende el área
localizada en la porción norte del polígono del parque
denominado Zona de Conservación de Humedales, con una superficie
de 1,643.9 ha. delimitada al Norte, Oeste y Sur por las líneas
rectas que unen los vértices I) 18° 28' 35" N, 87°
45' 47" W; II) 18° 28' 35" N, 87° 46' 56" W;
III) 18° 27' 04" N, 87° 47' 14" W; IV) 18° 26'
26" N, 87° 47' 05" W; V) 18° 24' 23" N, 87°
46' 58" W y VI) 18° 23' 51" N, 87° 46' 38"
W; y al oeste por el límite oriental del polígono VII)
18° 26' 07" N, 87° 46' 00" W.
- Zona de Uso Restringido Boca Río Hunch. Comprende un área
localizada al norte dentro del polígono marino del Parque en
la Zona de Repoblación Pesquera, con una superficie de 357.8
ha. delimitada al Oeste por la Zona Federal Marítimo Terrestre,
y al Norte, Este y Sur, por las líneas rectas que unen los
vértices: 1) 18° 25' 58" N, 87° 45' 51" W;
II) 18° 25' 58" N, 87° 45' 15" W; Ill) 18° 24'
21" N, 87° 45' 15" W; IV) 18° 24' 21" N, 87°
46' 10" W;
- Zona de Protección Bacalar Chico. Es un área localizada
en la porción Sur del polígono marino del parque, con
una superficie de 689.4 ha. delimitada por las líneas rectas
que unen los vértices: 1) 18° 11' 34" N, 87° 48'
30" W; II) 18° 11' 08" N, 87° 50' 54" W y III)
18° 09' 45" N, 87° 48' 50" W.
Zonas Marinas:
Definidas para proteger a las zonas de uso restringido del impacto exterior
y donde
sólo podrán realizarse actividades productivas emprendidas
preferentemente por la comunidad que ahí habite al momento de
la declaratoria respectiva o con su participación.
- Marina. Comprende la totalidad del polígono marino del parque
exceptuando las zonas Boca Río Huach y Bacalar Chico; se subdivide
a su vez, con base en las categorías de so permitidas para
cada área en:
Zona de Aprovechamiento Sustentable de los Recursos Naturales. Es
la parte Norte del polígono marino del Parque que rodea la
zona Boca Río Huach; sus límites Oeste, Norte y Este
corresponden a los del mencionado polígono, y el límite
Sur es la línea recta que une los vértices 1) 18°
21' 23" N, 87° 48' 00" W y II) 18° 20' 49"
N, 87° 46' 30" W.
- Zona de Uso Tradicional Pesquero. Es la porción Sur del
polígono marino del Parque, con excepción de las zonas
de agregación y reproducción de mero, uso turístico
y la zona Bacelar Chico, con la cual limita al Sur, sus límites
oriental y occidental corresponden a los del citado polígono;
y el límite Norte corresponde al límite Sur de la zona
de repoblación pesquera.
- Zona de Aprovechamiento Especial (agregación y reproducción
de mero). Es el área situada en la parte Sur del polígono
marino del Parque, dentro de la zona de uso pesquero, con una superficie
de 82.49 ha. con límites en las líneas que unen los
vértices 1) 18° 20' 54" N, 87° 44' 55" W;
Il) 18° 20' 42" N, 87° 47' 31" W; III) 18° 20'
15" N, 87° 47' 49" Wy IV) 18° 20' 28" N, 87°
48' 15" W.
- Zona de Uso Público. Situada en la parte Sur del polígono
marino del Parque, dentro de la zona de uso tradicional, con una superficie
de 897.1 ha. y limitada al Oeste por el límite del polígono
yal Norte, Este y Sur por las líneas rectas que unen los vértices
fl 18° 15' 55" N, 87u 50' 08" W; II) 18° 15' 48"
N, 87° 48' 48" W; Ill) 18° 13' 54" N, 87d48 56"

- Terrestre. Comprende la totalidad del polígono del parque
denominado Zona de
Conservación de Humedales, con excepción de la zona
de uso restringido Río Huach; sus límites son los mismos
que los del mencionado polígono.

Taking in consideration that a National Park intends to preserve
representative natural atmospheres of the different regions ecological
biogeographic and of the most fragile ecosystems, to assure
the balance and the continuity the ecological evolutionary processes;
to safeguard the genetic diversity of the wild species, specially
